TRADE MARK

A mark can be a device, brand, heading, label, ticket, name, signature, word, letter, numeral or any combination thereof.

A trademark is a mark used or proposed to be used in relation to goods or services to indicate a connection in the course of trade between the goods or services and the person having the right to use the mark as owner or registered user.

INDUSTRIAL DESIGN

Features of shape, configuration, pattern or ornament applied to an article of manufacture or handicraft by any industrial process, which in the finished article appeal to and are judged by the eye. The following features are excluded:

  1. A method or principle of construction;

    OR
  2. Features of shape and configuration
    1. dictated solely by the function of the article; or
    2. dependent upon the appearance of another article and which form an integral part of that article.

Article includes a set of articles, each article in a set of articles, and both a set of articles and each article in that set.
